What is dram shop law? 

Draw shop laws establish civil liability for injuries involving the consumption of alcoholic beverages. In Wyoming, they are applied in just a few situations. 

In a lot of states, liquor liability applies to two groups: 

  • Licensed alcohol vendors: Restaurants, bars, liquor stores, etc. 
  • Social hosts: Individuals who provide alcohol services in private settings. 

In Wyoming, there is only one exception where these groups have liquor liability for an intoxicated patron. 

Wyoming’s one exception for dram shop cases 

Licensed alcohol vendors and social hosts do not generally have civil liability for people drinking on their premises, even if a bartender is over-serving an intoxicated patron.  

The one exception is if they knowingly sell or serve alcohol to someone under 21. This is set by Wyoming statute § 12-8-301.
