Who is responsible for the deceased person’s estate? 

If there is a will, the person named in the will as executor will be appointed by the court as the personal representative. That person has the authority to file a claim on behalf of the deceased and surviving family members. 

If there is no will, a court will appoint a personal representative based on the priority order set by Montana Code 72-3-502. 

The order is typically: 

  • Surviving spouse 
  • Other heirs of the deceased 
  • Other suitable people may petition the court if no one else has applied 

The responsibilities of the personal representative 

  • Act in the best interest of the estate and its beneficiaries 
  • Administer the estate by paying debts and distributing assets 
  • File a wrongful death claim if deemed necessary

The time limit for filing your claim 

With wrongful death law in Montana, you have three years to file a wrongful death case. If the death occurred from homicide, then you have ten years.
