Who is responsible for the deceased person’s estate? 

A personal representative is the person responsible for managing a decedent’s estate. They are either appointed by the will or by the court if there is no will.   

In the case of there not being a will, the court appoints a personal representative following a statutory priority list:  

  • Surviving spouse  
  • Family members such as surviving children, surviving parents, or surviving grandparents  
  • Other heirs  
  • A trust company  
  • Any creditor of the estate after 45 days from the date of the death 

The responsibilities of the personal representative 

  • Locate and file the will with the court  
  • Petition the court to appoint you as personal representative
